These Terms of Service (“Terms”) govern your use of the www.daxeyewear.com website (the “Site”) and any purchases or interactions you make with DAXEYEWEAR LLC (“DAX Eyewear,” “we,” “us,” or “our”). By accessing or using our Site or services, you agree to these Terms, our Privacy Policy, and any other policies referenced herein.
If you do not agree to these Terms, please do not use our Site or purchase from us.
1. Eligibility & Account Creation
You must be at least 13 years old to use our Site. If you create an account, you are responsible for maintaining the confidentiality of your login information and for all activity that occurs under your account. You may also check out as a guest.
2. Orders, Payment & Taxes
All purchases are subject to availability and confirmation of the order total. We reserve the right to cancel or refuse any order for reasons including suspected fraud, inventory issues, or policy violations.
Prices are listed in USD. Payment is processed securely via Shopify Payments and related providers. Sales tax is collected automatically where required based on your shipping address.
3. Shipping, Returns & Warranty
Shipping times, methods, and eligibility for free shipping are outlined in our Shipping Policy.
We offer returns on most items within 30 days of delivery, subject to our Returns & Exchanges Policy.

We strive to display our products and prices accurately. However, we do not guarantee that descriptions, images, or pricing are error-free. We reserve the right to correct errors and update product details at any time.

All content on our Site, including product designs, images, logos, text, and graphics, is the property of DAX Eyewear or its licensors and is protected by copyright, trademark, and other laws. You may not use, copy, distribute, or modify our content without written permission.
6. Prohibited Conduct

- Interfere with the Site’s functionality or security

7. SMS/MMS Messaging
By providing your phone number at checkout or subscribing to SMS updates, you consent to receive marketing and transactional text messages from DAX Eyewear. Message frequency varies. Message and data rates may apply. Consent is not a condition of purchase.
You may opt out at any time by replying STOP to any text. For help, reply HELP or email hello@daxeyewear.com.
We use Klaviyo SMS and may also work with third-party providers like Postscript. Delivery is subject to your mobile carrier’s network and message compatibility.

8. Disclaimer of Warranties
We provide our Site and products “as is” and “as available,” without warranties of any kind, express or implied, including but not limited to merchantability, fitness for a particular purpose, or non-infringement.

9. Limitation of Liability
To the maximum extent permitted by law, DAX Eyewear and its affiliates shall not be liable for any indirect, incidental, special, or consequential damages arising out of or related to your use of the Site or purchase of our products.
Our total liability for any claim arising out of or related to these Terms or your purchase shall not exceed the amount paid for the applicable product.
10. Dispute Resolution & Arbitration Agreement
Any dispute, claim, or controversy arising out of or relating to these Terms or your use of the Site shall be resolved through final and binding arbitration in Nevada, Texas under the rules of the American Arbitration Association (AAA).
Class Action Waiver: You agree to resolve any disputes with us individually. You may not bring a claim as a plaintiff or class member in a class or representative action. Arbitration shall be conducted by a neutral arbitrator and not in a court of law.
This section survives termination of these Terms or your relationship with DAX Eyewear.
11. Governing Law
These Terms are governed by and interpreted under the laws of the State of Texas, without regard to conflict of laws. Any disputes not subject to arbitration will be resolved exclusively in the state or federal courts located in Collin County, Texas.
12. Updates to These Terms
We may update these Terms from time to time. When we do, we will revise the “Last updated” date above and post the updated version on our Site. Your continued use of the Site after changes are posted constitutes your acceptance of the revised Terms.
