3. Product, Health, & FDA Disclaimer

DAX Eyewear sunglasses are designed for fashion and general protection against UV rays. They are not intended to treat, cure, or prevent any medical condition. In accordance with US FDA regulations (21 CFR 801.410), our lenses are impact-resistant; however, they are not shatterproof or unbreakable. Our sunglasses are not classified as safety glasses and should not be used as protective eyewear in hazardous environments, industrial environments, or high-contact sports.

 

4. Accuracy of Information & Colors

We strive to display the colors and details of our sunglasses as accurately as possible. However, because the colors you see depend on your computer monitor or mobile device screen, we cannot guarantee that your monitor's display of any color will be 100% accurate. We reserve the right to correct any errors, inaccuracies, or omissions relating to product descriptions, pricing, and availability at any time without prior notice.

 

5. User-Generated Content (UGC) & FTC Disclosures

We love seeing how you style your DAX Eyewear! By tagging our brand accounts or using our branded hashtags (e.g., #DAXEyewear) on social media, you grant us a non-exclusive, royalty-free license to use, reproduce, and display your content on our website and marketing channels. Furthermore, any influencers, ambassadors, or affiliates compensated by DAX Eyewear are required to clearly and conspicuously disclose their material connection to our brand in accordance with FTC guidelines (such as using the #ad or #sponsored hashtag).

9.1. Indemnification


You agree to indemnify, defend, and hold harmless DAX Eyewear from and against any claims, damages, liabilities, costs, or expenses arising from your use of the website or your violation of these terms.

 

10. Sale and Discount Code Exclusions:

Sitewide sales and promotions may exclude select products and collaborations. Sitewide offers like our Bundle Offer cannot be combined with other promotions or coupon codes. Promotional prices during a sale are only applicable during the sale period and can be changed at any time. Discount codes may expire at any time.

 

11. DAX Eyewear Store Credit & Loyalty Program, aka "The Shade Society," Terms and Conditions:

a. General Overview As part of the DAX Eyewear Loyalty Program, customers may earn store credit based on qualifying purchases made directly on DAXEyewear.com. By participating in this program and accumulating or using store credit, you agree to the following terms and conditions.

b. No Cash Value DAX Eyewear store credit is a promotional value and is purely a mechanism for discounting future purchases. Store credit has no actual cash value, fiat value, or monetary equivalent. It is not a credit card or debit card. Under no circumstances can store credit be redeemed, exchanged, cashed out, or refunded for real currency (including but not limited to cash, check, credit card refunds, or wire transfers).

c. Redemption and Usage Restrictions Store credit may only be applied toward the purchase of eligible merchandise on DAXEyewear.com.

  • Non-Transferable: Store credit is tied directly to the customer account that earned it. It cannot be sold, transferred, gifted, or combined with the store credit of another account.

  • Limitations: Store credit cannot be used to purchase physical or digital gift cards, nor can it be used to pay for prior purchases or outstanding balances.

d. Returns and Cancellations If you return merchandise that was purchased partially or entirely using store credit, the portion of the purchase paid for with store credit will be refunded back to your DAX Eyewear account as store credit. It will not be refunded as cash or credited back to a standard payment method (e.g., credit card or PayPal).

e. Program Modifications and Termination DAX Eyewear reserves the right, at our sole discretion, to modify, suspend, or terminate the Store Credit Loyalty Program, or change the terms and conditions regarding the earning and redemption of store credit at any time, with or without notice. In the event of program termination, DAX Eyewear reserves the right to void any unused promotional store credit.

f. Account Closure If your DAX Eyewear account is closed or deleted—whether voluntarily by you or terminated by DAX Eyewear due to a violation of our general Terms of Service—any unused store credit associated with your account will be immediately and permanently forfeited.
